Control Disclaimer — Joint-Employer Risk Mitigation
Field audits are designed to verify brand standards and system-wide compliance only. They must not be used to direct or control franchisee day-to-day operations, including hiring, firing, scheduling, supervision, wages, employee conduct, or other personnel management decisions.
Audit templates and corrective actions that prescribe how franchisees manage their own employees can create evidence of a joint-employer relationship under NLRB and state labor law. Keep checklist items focused on observable brand standards (cleanliness, product quality, signage, safety, customer experience) — not on staffing levels, employee performance, or labor practices.
Franchisors are encouraged to customize all templates to their system and remove any items that could be construed as operational control over franchisee employees.
Photographic Evidence Privacy: All audit photos are automatically analyzed for faces and employee identifiability. Photos with visible faces are flagged for privacy masking (face blur) and tagged as brand-standard verification only — they must not be used as evidence of direct supervision. This safeguard prevents audit photos from establishing joint-employer status under NLRB and state labor law.
Local Code Override Verification
AI-generated audit checklists may reference safety or health standards that conflict with local municipal codes. Verify the checklist against the specific local regulations for the franchisee's zip code before using it for field audits.
Geo-Fencing & Location Data — Joint-Employer Disclaimer
Location data collected during field audits (GPS coordinates, geo-fenced check-ins, and timestamped verification) is used solely to verify that the audit event occurred at the designated franchise location at the reported time. This data is collected for brand-standard compliance verification only and is not used to supervise, monitor, direct, or control franchisee employees or personnel. The platform and franchisor do not use geo-fencing to track employee movements, work hours, breaks, or individual performance. No employment relationship, joint-employer relationship, or direct control over franchisee workforce operations is created or implied by the collection of this audit verification data.
Corrective action classified as Brand Standard Observation — compliant with NLRB joint-employer standards.
Manner-and-Means Imperative Verb Filter
Scans HR-related checklist items for prescriptive imperative verbs ('require', 'must', 'shall') that support a finding of joint-employer status under NLRB standards.
PII Redaction — NER Filter
Automatically redact personally identifiable information (names, phone numbers, emails, addresses) from inspector notes and remediation steps using Named Entity Recognition.
Time-on-Site Duration Mask
Precise audit entry/exit timestamps can be used as evidence of franchisor control over franchisee labor time in joint-employer litigation. When masked, only audit completion status and date are logged — precise duration data is hidden from the record.
Provide this downloadable consent template to your employees notifying them that their location is tracked during field audits.
Wage & Hour Fiduciary Disclaimer
This platform is not a system of record for payroll, wage, or hour calculations. Any time-tracking, scheduling, or audit data displayed here is for operational reference only and must not be used for payroll determination. The franchisee is solely responsible for compliance with the Fair Labor Standards Act (FLSA), including overtime calculations, meal/rest break compliance, and minimum wage requirements. The franchisor and platform disclaim all liability for wage-and-hour violations arising from the use of these tools for payroll purposes.
